Terms of participation in the Veganz ‘Choc Bar Peanut Caramel’ product test

The Veganz product test for the Choc Bar Peanut Caramel is a limited-time promotion by Veganz Group AG, Warschauer Str. 32, 10243 Berlin (hereinafter ‘Veganz’) and takes place on the Veganz website https://veganz.com/product-test/choc-bar-peanit-caramel (hereinafter ‘product test platform’).
Participation in this product test is governed exclusively by these terms of participation.
Veganz reserves the right to change, suspend, or terminate the terms of participation at any time without prior notice or justification. This option may be exercised in particular if proper implementation of the product test is no longer guaranteed for technical or legal reasons.

Requirements for participation

The registration phase for the product test starts on Monday, 18.04.2022 from publication on the product test platform and ends on Sunday, 24.04.2022 at 23:59. The requirements for participation in the promotion is that you expressly agree to the terms of participation and that your place of residence is in Germany or Austria. By registering and providing all the required personal data, you acknowledge and accept these terms and conditions.
A total of 400 product testers will be drawn at random among all product test applicants. The product testers can be published and named by Veganz and other print and online media (e.g., Internet, magazine, social media, etc.), including their first name and product rating.

The test product is not eligible for replacement. A cash payment of the product value is excluded.
Any taxes on the product value will be borne by Veganz Group AG.
Should it not be possible to provide the product for the test for reasons for which Veganz is not responsible, Veganz reserves the right to provide an equivalent replacement.

Participation is free of charge and independent of a purchase or other conclusion of a contract.

Eligibility

Persons aged 16 and over who reside in Germany or Austria are eligible to participate.

Participation via entry services and automated entries as well as participation with falsified identities or with identities of third parties are not permitted.

Persons under 16 years of age require the consent of their parent or legal guardian to participate. Should this consent not be provided, participation in the product test is not permitted.

Also excluded from participating in the product test are employees of Veganz Group, their relatives, and any persons involved in the product test, in particular those involved in the technical and/or organisational implementation or execution.
Each participant may only participate in the product test once. Multiple entries are not permitted. Veganz reserves the right to exclude participants from registering for the product test if they register multiple times.
Veganz may cancel or terminate the product test at any time without prior notice and without justification. Veganz may make use of this right in particular should a proper execution of the product test no longer be possible for technical or legal reasons.

Registration, notification, product transfer, and closing date for participation

There is no remuneration for participation in the Veganz product test, i.e., the participant is not paid to participate or to provide a review.

To use the product test platform and to participate in the product test, the participant must fill in all the mandatory fields marked with a * on the product test platform.

In particular:

Participation in the product test on the product test platform is free of charge. To register for the product test, the participant is required to fill in all the mandatory fields on the form provided. Participants are required to provide full and truthful information during registration.
The number of testers per product test is limited. The test participants are chosen at random among the applicants. The randomly selected test participants will receive an email confirming their participation in the test. The products to be tested will be sent by Veganz to the address provided by the tester within one week. Should the products to be tested not be available for any reason or should it not be possible to send them for technical reasons, the participant has no legal claim to receive a replacement delivery of the product to be tested.
The submission of the review of the respective product takes place via a Veganz product survey. The link to the platform will be sent to the tester by email. For this purpose, the participant will be asked predefined questions about the tested product.
The cumulative test results as well as general information on the characteristics of the test participants (e.g., gender, region) can only be published anonymously in Veganz online and print media.
By submitting a review, the participant grants Veganz the non-exclusive, royalty-free right to publish their first name and review on the product test platform. By registering, the participant confirms that Veganz holds all rights to the submitted reviews and that uploading for publication on the product test platform and for further use online and in print is permitted.

Datenschutz

The participant agrees to the collection, processing, and use of their data (name, address, email, if applicable) by Veganz Group AG, Warschauer Str. 32, 10243 Berlin for the purpose of carrying out and processing the product test and to the forwarding of such data to third parties by Vekoop.

For minors, the aforementioned consent must be provided by the parent or guardian.
The information provided will only be used to contact the product testers and for the type of publication described in this document. The participants’ data is not archived and is destroyed after the promotion. Once the product test has ended and distribution of the prizes has taken place, the personal data collected will be deleted, unless there is an obligation to temporarily store the data for legal reasons.

The participant may object to the use of their data at any time in writing or by email to Veganz at marketing@veganz.de. This will result in the personal data no longer being processed and used. They are then excluded from the product test. If the participant has not registered for our newsletter, the data will be deleted in its entirety once the product test has been completed.

Disclaimer

Veganz is not liable for products that are received late. Furthermore, warranty claims for material defects and/or defects of title are excluded. These shall be asserted with the manufacturer of the product.

Veganz is only liable for intentional or grossly negligent behaviour, for intentional or grossly negligent behaviour of its vicarious agents, or intentional or grossly negligent violation of cardinal obligations. This shall not apply to damages in the event of injury to life, body, and/or health.

Applicable law

The law of the Federal Republic of Germany shall apply exclusively. Legal recourse is excluded. Should any provisions of these terms of participation be or become invalid, this shall not affect the validity of the remaining terms of participation.

Miscellaneous

Should any provisions of these terms of participation be or become invalid, this shall not affect the validity of the remaining provisions. Rather, the invalid provision shall be replaced by a provision that comes as close as possible to the intended purpose.
